Abstract : Construction dispute cases are considered one of the major dispute areas resolved by the judiciary, in which the sum of disputed money is relatively large. As a result of this increase in the dispute cases in the country, a practical and efficient means of dispute resolution is needed. Law and regulations of dispute resolutions in the industrial countries are developed rapidly due to the need for quick and economical mechanism. The disputants looked for an alternative system to the court and government jurisdiction such as negotiation, mediation, conciliation, arbitration etc. These systems used to resolve all kind of dispute such as family dispute, administration, trade, industrial, and international disputes. As a result of the complications encountered in some of the alternative resolution methods such as arbitration, which was originally developed as an alternative to the complicated court system and lawyers practices. The engineering industry started in the nineties to develop a new mechanism for dispute resolution known as “Dispute Resolution Board”. The “Dispute Resolution Board” spread quickly in the United State and slowly in the rest of the industrial countries and proved to be an efficient way of resolving dispute before it forms a claim. The development stage of the Dispute Resolution Board system in the world is discussed in this paper with a special reference to the United State utilization of the system through the American Arbitration Association procedure. Important aspects of the system and its rules and regulations are presented. The current state of the dispute resolution cases in Saudi courts is also discussed and the advantage of using the mechanism of the Dispute Resolution Board in Saudi Arabia is outlined.
