Abstract : We have taken into consideration in this study (The Theory of Individual Faculty), Whereas endeavors have been made to explain the ability of this faculty upon forming the obligations and producing legal affects on Islamic approach which could be dealt with. We have approved within the study evidences authentic consideration and practical application. The faculty is- able and capable, as soon as it asserts in itself to establish obligations even if it is not associated with another faculty, there for, this avails to ourselves to consider it as an independent general source for the obligation, beside the contract and other sources as prevailing within the general theory of obligations. Our Planning in this study evidential program instituted upon theory of research, analysis and?Comparison instituted upon searching within all Arab countries Laws, as, well al talking into my consideration judicial judgments if there is any necessity to them. If also instituted this theory upon comparison with the Sheria concept in order to define the attitude of Islamic jurists from such concept of obligations by the individual faculty.
