Abstract : Delinquency in debt repayment by a solvent debtor is an especially serious problem in an Islamic Economy which clearly prohibits interest on debt. One recent juristic opinion suggested permitting monetary compensation by court order, to be imposed on the delinquent but solvent debtor to the benefit of the creditor. with compensation covering both any actual loss due to delinquency plus potential profits misted. That opinion was strongly challenged by other jurists. This paper critically surveys the different opinions and solutions offered for delinquency and suggests a new method of compensation that requires a delinquent but solvent debtor to repay the principal, and to extend to the creditor an interest-free loan that is equal in amount to the original principal and in duration to the period of delinquency.
